Restricted substances (Art. 5)

Check PFAS, heavy metals, SVHC and bisphenols per component against the thresholds of the regulation.

What does Art. 5 govern?

Art. 5 restricts substances in packaging that endanger recycling or health. It covers above all PFAS in food-contact packaging, the sum of the heavy metals lead, cadmium, mercury and chromium(VI), and substances of very high concern under REACH.

Unlike recycled content there is no transitional quota here: the threshold is either met or it is not. Reguly keeps the measured or supplier-declared values per component and computes the status live against the limits.

Which substance groups does Reguly track?

  • PFAS. Per- and polyfluoroalkyl substances. Food-contact packaging carries its own limit.
  • Heavy metals. Lead, cadmium, mercury and chromium(VI) — the sum is assessed, not the individual value.
  • SVHC. Substances of very high concern under REACH, from the notification threshold in the article.
  • Bisphenols. Above all BPA in coatings and thermal paper.

    The entry attaches to the packaging component, not the product — a bottle and its cap are assessed separately.

    Measured value or supplier declaration, with unit. Reguly compares against the threshold immediately.

    A laboratory test report or the supplier’s declaration. Without evidence the status stays open.

Art. 5 has no transition period

While the recycled-content quotas only bite in 2030, the substance restrictions apply from the date of application. Exceeding them is not a planning matter but a reason not to place the packaging on the market.

Common questions

Do I have to have every component tested?
Not necessarily. A solid supplier declaration is enough as long as it refers to the delivered batch. Reguly treats both as equivalent but records which source it was.
How does this connect to the declaration of conformity?
The values feed the technical documentation and support the declaration under Annex VIII. An open substance row stays visible there as a gap.
